Title: Can there be multiple different society registrations of the same track?

Last Reviewed: Mar 21, 2017
Keywords: multiple registrations, non-exclusive publishing administration, retitled registrations

Q.  Can there be multiple different society registrations of the same track?

A.  Each track can potentially have multiple different registered instances of it.  For example, the owner may have their own instance registered so that if they license it to a client directly, they can administer their own publishing and directly earn the performance royalties for use on TV.  But also they work with AudioSparx music library, and also potentially other libraries as well, and can permit each library to register the same tracks but as “retitles” so the newly-registered instances have unique titles that don’t conflict with the original track titles (which is not permitted at the societies, because the registrations would then be duplicative for the exact same title).

So then when AudioSparx licenses a track, if the track's owner has designated AudioSaprx to administer their publishing here, then we file a cue sheet with our listed instance of the track on the cue sheet.  In this way, we and the track's composer(s) share in the performance royalties that are earned for a use of it on TV. This is the essence of “non-exclusive publishing administration”.  Our re-titled registration of the track simply has a revised title that appends “aalibrary” to the end of the original title during registration at the societies to make the title unique.

On a related note, keep in mind that our right to license the track to clients is not derived from the society, rather, it is derived from the owner of the track.  So our license to the client is a direct license from the track's owner to us, and then from us to our client.  For any track owners we also happen to administer publishing for, we also license their tracks to the US societies, who then license them to other societies around the world.
